TERMS & CONDITIONS

Last updated: 5 October 2026

These Terms & Conditions (“Terms”) apply to your use of sugariangroup.com (the “website”) and to products you order through it. Please read them carefully, especially the sections on orders, refunds and our liability. By using the website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.

Your rights under the Australian Consumer Law are not affected by these Terms. See section 15.

1. About us

The website is operated by Sugarian Group Pty Ltd (ABN 77 670 070 112) (“Sugarian Group”, “we”, “us” or “our”). We operate and franchise the brands Cheong Kee Fish Ball, CHICHA San Chen, Chung Kee Noodles and Master Ngan in Australia. Some stores may be independently owned and operated by franchisees.

These Terms include our Privacy & Cookies Policy and any extra terms shown on the website for a particular service, program or promotion. If those extra terms are inconsistent with these Terms, the extra terms apply to that service, program or promotion.

2. Using our website

You may use the website only for lawful purposes. You must not:

  • interfere with, disrupt or try to gain unauthorised access to the website, our systems or other users’ accounts;

  • use bots, scrapers or other automated means to copy or extract content, prices, product codes or images;

  • upload or send anything that is unlawful, harmful, misleading, offensive or that contains viruses or malicious code;

  • pretend to be someone else, or use another person’s payment details without permission; or

  • use the website or its content for commercial purposes without our written consent.

We may suspend or restrict your access if we reasonably believe you have breached these Terms. We aim to keep the website available, but it may sometimes be unavailable because of maintenance or events outside our control.

3. Accounts and member areas

  • You must give us accurate information and keep it up to date.

  • Keep your login details secure. You are responsible for activity on your account, unless it happens because of our own failure. Tell us straight away if you think your account has been misused.

  • The staff, franchisee and wholesale areas are only for people we have authorised. Do not share your login. Information in those areas is confidential and must not be shared outside your business.

  • We may suspend or close an account that is used fraudulently or in breach of these Terms. You can close your account at any time by contacting us.

4. Products, prices and information

  • Product photos and descriptions are for illustration. Packaging, colour and presentation may vary.

  • Menus, prices, opening hours and product availability vary between stores and may change. Prices in store may differ from prices online.

  • Prices are in Australian dollars and include GST unless stated otherwise. Delivery fees are shown at checkout before you pay.

  • We work hard to keep information accurate. If a product is listed at an obviously incorrect price or with an incorrect description, we do not have to supply it on those terms. We will contact you, and you can choose to go ahead at the correct price or cancel for a full refund.

5. Online orders and payment

  • When you place an order, you are making an offer to buy the products. The email we send after checkout confirms we have received your order. We accept your order when we dispatch it, or when we tell you it is ready for pick-up.

  • We may decline or cancel an order, for example if a product is unavailable, a price is wrong, we suspect fraud, or we cannot deliver to your address. If we cancel, we will refund the full amount you paid.

  • You must pay in full at checkout using one of the payment methods offered. Payments are processed by third-party payment providers. You must be authorised to use the payment method you choose.

  • Promotional codes can be used only as stated in the promotion, have no cash value, and cannot be applied after an order is placed.

6. Delivery and pick-up

  • We deliver to Australian addresses only. Delivery times shown are estimates.

  • Please check your delivery address carefully and make sure someone can receive your order, especially frozen or chilled products. Store products as directed on the label as soon as they arrive.

  • Risk in the products passes to you when they are delivered to your address (or left there in line with your instructions) or when you collect them. Ownership passes to you once we have received full payment.

  • For pick-up orders, please collect your order from the store you chose within the time stated in your pick-up confirmation. If an order is not collected after we have tried to contact you, we may cancel it.

7. Refunds, returns and faulty products

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

  • Change of mind: for food safety reasons, we do not accept returns or give refunds for change of mind (for example, if you ordered the wrong item) once an order has been dispatched or collected.

  • Damaged, faulty, incorrect or missing items: please contact us as soon as possible (for frozen and chilled products, ideally within 48 hours of receiving them) with your order number and photos, so we can investigate. We will provide a refund, replacement or other remedy as required by the Australian Consumer Law.

  • Please do not eat any product you believe is unsafe. Keep it, and its packaging, until we have been in touch.

  • Refunds are made to the original payment method.

8. Food safety, allergens and storage

  • Our products may contain, or may have been in contact with, common allergens including fish, crustacea, wheat (gluten), egg, milk, soy, sesame, peanuts and tree nuts. Always read the product label and ingredient list, or ask us before you order. We cannot guarantee that any product is free from allergens.

  • Follow the storage, handling and cooking instructions on the label. Keep frozen products frozen at −18°C or colder, do not refreeze products once thawed, and use products by the date shown.

  • Food and drinks prepared in store are made to be enjoyed straight away.

  • Ingredient and nutrition information may change when recipes or suppliers change. The product label is the most up-to-date source.

9. Rewards, referrals and promotions

  • Our rewards and referral programs are optional and free to join. Points and rewards have no cash value, cannot be transferred or exchanged for cash, and may expire as set out in the program details.

  • We may change, suspend or end a program. Where practicable, we will give reasonable notice before a change that reduces the value of your points.

  • We may cancel points or rewards obtained through fraud, misuse or a breach of these Terms.

  • Promotions are subject to the terms published with them.

10. Franchise information

  • Information about franchising on this website is general information only. It is not an offer to grant a franchise, a disclosure document, or financial, legal or investment advice.

  • Any franchise will be offered only in line with the Franchising Code of Conduct. This includes giving you the documents the Code requires, such as a disclosure document and a copy of the franchise agreement, at least 14 days before you sign a franchise agreement or pay any non-refundable money.

  • Figures, store counts, timeframes and examples on this website are indicative only and may change. Unless set out in a disclosure document, we do not make any representation about the sales, income or profit a franchise may achieve.

  • Sending an enquiry or application does not create any obligation for you or for us. We may decline any application, and some brands require approval from the brand owner.

  • We strongly recommend that you get independent legal, accounting and business advice before you sign a franchise agreement.

11. Franchisee, wholesale and internal orders

This section applies to orders placed through the franchisee, wholesale and internal ordering pages, which are only for approved franchisees, wholesale customers and authorised staff.

  • An order you submit is a request only. It becomes a binding order only when we confirm it in writing (by email or through the ordering page).

  • Unless we agree otherwise in writing, payment is by bank transfer before pick-up or dispatch. The pick-up date you choose is a preference, which our office confirms once payment is received.

  • Trade prices, product codes and availability are confidential and may change depending on stock and operational needs.

  • Please check goods when you collect or receive them, and tell us about any shortage, damage or quality issue within 2 business days so we can investigate while the goods are still fresh.

  • If you have a franchise agreement, supply agreement or other written agreement with us, that agreement applies if it is inconsistent with these Terms.

12. Your content and feedback

If you send us reviews, photos, ideas or other content through our website, forms or chat, you give us a free, non-exclusive, worldwide licence to use, copy, adapt and publish it in connection with our business. You confirm that you own the content (or have permission to share it) and that it is lawful and not misleading. We will ask your permission before we share content you post on your own social media accounts.

13. Intellectual property

All content on this website, including text, photos, graphics, logos, product names and codes, and the design of the website, is owned by us or licensed to us. Cheong Kee Fish Ball, CHICHA San Chen, Chung Kee Noodles, Master Ngan and Sugarian, and their logos, are trade marks owned by Sugarian Group or by their respective owners, who license them to us. You may view and print pages for your personal, non-commercial use. You must not otherwise copy, reproduce, modify, distribute or commercially use any content without our prior written consent.

14. Third-party links and services

Our website links to and uses third-party websites and services, such as Google Maps, Instagram and payment providers. We do not control them and are not responsible for their content or practices. Their own terms and privacy policies apply.

15. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law, or any other right that cannot lawfully be excluded or limited (“Non-Excludable Rights”). If you have a problem with a product or service, please contact us first. You can also contact NSW Fair Trading.

16. Limitation of liability

Subject to your Non-Excludable Rights and to the extent permitted by law:

  • the website and its content are provided “as is”, and we do not promise that the website will be uninterrupted, error-free or free from viruses;

  • we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or business opportunity, arising from your use of the website or our products;

  • where the law allows us to limit our liability for a failure to comply with a consumer guarantee (for example, for goods not of a kind ordinarily acquired for personal, domestic or household use), our liability is limited, at our option, to replacing the goods, supplying equivalent goods, or paying the cost of doing either; and

  • our liability is reduced to the extent that you caused or contributed to the loss.

17. Indemnity

You are responsible for, and agree to make good, any loss, damage or reasonable costs (including legal costs) we suffer because you breach these Terms, misuse the website or infringe someone else’s rights, except to the extent that we caused or contributed to it.

18. Events outside our control

Subject to your Non-Excludable Rights, we are not liable for any delay or failure caused by events outside our reasonable control, such as natural disasters, extreme weather, pandemics, supply shortages, courier delays, power or internet outages, or government action. If such an event affects your order, we will let you know, and you may cancel the affected order for a refund.

19. Privacy

Our Privacy & Cookies Policy explains how we collect, use and protect your personal information, and how we use cookies.

20. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law, our products or how we operate. The updated Terms apply from the date they are posted on this page, to your use of the website and to orders placed after that date. Changes do not affect orders already placed. If we make a significant change, we will take reasonable steps to let members know.

21. General

  • These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.

  • If any part of these Terms is found to be invalid or unenforceable, it will be read down or severed, and the rest of these Terms will continue to apply.

  • If we do not enforce a right under these Terms straight away, we have not given up that right.

  • We may transfer our rights and obligations under these Terms to a related company or to a buyer of our business, provided this does not reduce your rights. You may not transfer your rights without our written consent.
